Plain English: cuekit early access is coming soon. These terms apply when you purchase, download, install, or use the app. Early access builds may change, and you may not redistribute or reverse-engineer the software.

1. Overview

These Terms of Service ("Terms") govern your use of cuekit ("cuekit" or the "Software"), a macOS application developed by Lauren Drohan ("we," "us," or "our"). By purchasing, downloading, installing, or using cuekit, you agree to these Terms.

2. License

Upon purchase, we grant you a personal, non-exclusive, revocable, non-transferable license to install and use cuekit on Mac computers that you own or control, subject to these Terms and any device activation limits that apply to your purchase.

Unless otherwise stated at the time of purchase, a cuekit license includes access to the version you purchased plus updates we choose to provide for it.

3. Early access status

cuekit is preparing for early access. Early access builds may change, evolve, be delayed, or be removed. You understand that early access software may contain bugs, incomplete functionality, compatibility issues, or other rough edges that would not appear in a fully mature release.

4. Purchase, payment, and taxes

When cuekit is available for purchase, it will be sold at the price listed on our website at the time of purchase. Payment is processed through Lemon Squeezy, which acts as Merchant of Record for cuekit purchases. Lemon Squeezy may charge, collect, and remit applicable taxes and may impose its own checkout terms, billing terms, and fraud-prevention controls.

We may change pricing for future purchases, but the price you paid for your order is the price that applies to that order.

5. Refund policy

We offer a full refund within 30 days of purchase. To request a refund, email hello@cuekit.ca with your order number, or use any refund process made available through Lemon Squeezy. Approved refunds are typically processed by the payment provider, not manually by us. Nothing in these Terms limits any non-waivable consumer rights you may have under applicable law.

6. Updates

We may release updates, bug fixes, changes, or improvements to cuekit at our discretion. We are not obligated to provide any specific roadmap item, feature, release schedule, or compatibility commitment beyond what is required by applicable law.

7. Privacy

cuekit is local-first, but limited personal information may be processed for payments, licensing, and support. For details, see our Privacy Policy.

8. Support

During early access, support is provided on a reasonable-efforts basis by email. We do not promise response times, uptime commitments, or enterprise support levels.

9. Intellectual property

cuekit, including its code, design, name, and logo, is the intellectual property of Lauren Drohan. All rights not explicitly granted in these Terms are reserved.

10. Feedback

If you send us ideas, suggestions, bug reports, or feedback about cuekit, you grant us a non-exclusive, worldwide, royalty-free, perpetual license to use that feedback to improve, market, and support cuekit without owing you compensation.

11. Disclaimer of warranties

To the fullest extent permitted by applicable law, cuekit is provided "as is" and "as available" without warranties of any kind, express, implied, or statutory. We do not warrant that cuekit will be error-free, uninterrupted, secure, or compatible with every system, workflow, or third-party service.

12. Limitation of liability

To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, or business opportunity arising from or related to cuekit. Our total aggregate liability relating to cuekit will not exceed the amount you paid for the specific license giving rise to the claim.

13. macOS permissions and third-party services

cuekit may request macOS permissions such as Calendar, Accessibility, and Location while in use. Some features also depend on third-party services such as Google Calendar, Slack, OpenWeather, and Lemon Squeezy. We are not responsible for outages, policy changes, account restrictions, or service changes imposed by those third parties.

14. Termination

We may suspend or terminate your license if you violate these Terms, misuse the software, or obtain the software fraudulently. Upon termination, you must stop using cuekit and delete your copies unless applicable law requires otherwise.

15. Changes to these Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new "Last updated" date. If you continue using cuekit after the updated Terms take effect, you agree to the revised Terms.

16. Governing law

These Terms are governed by the laws of the Province of Nova Scotia and the federal laws of Canada applicable there, without regard to conflict of laws rules. Unless applicable law requires otherwise, you agree that disputes relating to cuekit will be brought in the courts located in Nova Scotia, Canada.
